Student Discipline and Due Process

The Board of Trustees recognizes the need for a student discipline process that allows students the right to due process. The Board, therefore, authorizes the Administration to establish procedures for implementing the policy for student discipline and due process.

Discipline
Disciplinary sanctions include, but are not limited to:

  • Expulsion - permanent exclusion or removal from the College, with re-enrollment and attendance only upon express consent of the Board.

  • Suspension - exclusion from the College for a definite period of time.

  • Administrative Withdrawal - exclusion from a particular course, with permission to attend others, with a corresponding grade of a "W" in accordance with established College policies.

  • Deduction of grade.

  • Probation not to exceed one academic year and which may include suspension of certain other privileges during the probationary period.

  • Censure or reprimand - subject to further and more severe discipline in the even of further violations of College rules or policies.

A student who is expelled or suspended from the College will not be permitted access to College property and may not participate in any College activities during the period of suspension or expulsion. A student who is expelled, suspended, or removed form a class or course will not be entitled to a refund, either in whole or in part, of any tuition or fees.

Due Process
All recommendations for expulsion or suspension shall be directed to the dean of Student Development, who may also initiate such action on his/her own authority. In either case, the dean shall meet with the student within seven calendar days of receipt or initiation of such a recommendation. Upon receiving or initiating a recommendation for expulsion or attending any classes or participating in any other College activities until the meeting with the student is held.

At this meeting, the dean shall provide the student with :

  1. Notice of the recommendation.
  2. The facts or allegations upon which the recommendation is made.
  3. The opportunity to discuss the allegations and to provide such information as the student deems necessary.
  4. The right to appeal.

At the conclusion of the meeting, the dean may either:

  1. Impose such lesser discipline, as he/she deems appropriate under the circumstances.
  2. Recommend to the president that such student be expelled or suspended. In such case, the dean shall:
    1. Notify the student of his/her recommendation.
    2. Notify the student of his/her appeal rights and procedure.
    3. Have the authority to suspend the student pending completion of the appeal procedures.

If at the conclusion of the meeting with the student the dean recommends to the president expulsion or suspension, the student may request a meeting with the president to:

  1. Discuss the recommendation and the reasons for the recommendation.
  2. Provided such information as the student deems appropriate or relevant.

This meeting with the president must be scheduled within seven calendar days of the student's receipt of the dean's recommendation for expulsion or suspension. The president shall render a decision three calendar days of the meeting with the student.

If the student does not request a meeting with the president after receiving the dean's recommendation, the president shall render a decision within seven calendar days of receipt of the dean's recommendation. In either case, the decision of the president shall be final and binding.

All recommendations for exclusion or removal from a course or class, for reprimand or censure or for probation, shall be directed to the dean, who may also initiate such action upon his/her own authority. Where such a recommendation is received or initiated by the dean, he/she shall meet with the student within seven calendar days and shall provide the student with:

  1. A notice of the recommendations.
  2. The facts or allegations upon which the recommendation is made.
  3. The opportunity to discuss the allegations and to provide such information as the student deems necessary.
    1. At the conclusion of the meeting, the dean may impose such discipline as he/she determines appropriate under the circumstances, and he/she shall so notify the student of the decision and of the student's appeal rights. Unless appealed, the dean's decision shall be final.
    2. The student may appeal the decision of the Dean to the President within seven calendar days of receipt of the Dean's decision. The President will, within three calendar days after meeting with the student, render a decision in writing. This decision shall be final.
